Buying items/gold/used accounts is against the EULA. Buying a sealed box/unused key is not.

Pretty sure they are not. I know when the Factions first came out, they made far too few CEs and a reprinting was ordered. Probably got their hopes too far up and made too many, and just made an inflated number of copies for NF.
Then again, the items in the Factions and NF CEs aren't very appealing.
